August 21 deadline – EPA rule: Minor New Source Review Program Air Permitting Public Participation Requirements for State Implementation Plans
The EPA is proposing to remove any federal requirements for “minor source” permit public participation. Under the EPA’s proposal, data centers and other pollution sources would no longer have to disclose their pollution or accept public scrutiny, and states would not be required to provide public participation to impacted communities. Communities are deeply concerned about air pollution from data centers and an increasing number of data centers are looking at using on-site generation to meet grid capacity constraints, and as the largest data center hubs are increasingly called on to meet energy needs with on-site backup generators. Public participation is a key element in protecting public health and stopping harmful practices and ensuring that permitting authorities are adhering to the law. The Clean Air Act requires state air quality compliance plans to include public participation. States must develop State Implementation Plans (SIPs) to bring districts into compliance with National Ambient Air Quality Standards (NAAQS). Under the Clean Air Act (CAA), plans must include provisions for public participation in developing permitting processes.

August 24 deadline – BLM Rule: Oil and Gas Leasing
The Bureau of Land Management proposed a new rule to make it even easier for fossil fuel companies to drill on public lands and leave taxpayers to clean up their pollution. This rule would lower the bond amounts required by oil and gas companies that use public lands to drill by more than 90% from $125K per site to $10K per site. These bonds are needed to cover the expense of plugging wells and remediating sites. It also prevents public review of proposed public land sales and leases for oil and gas.
